Pali™ by Total Life Dynamics
These Beta Program Terms ("Terms") govern your participation in the beta testing program (the "Program") for Pali™, a pre-release iOS and watchOS application from Total Life Dynamics, Inc. ("Total Life Dynamics," "we," "us"). By checking the acceptance box on the Program sign-up form, requesting or accepting a TestFlight invitation, or installing or using a beta version of Pali, you agree to these Terms.
If you are participating through an organization that has a separate written agreement with Total Life Dynamics (such as a non-disclosure agreement), that agreement governs where it conflicts with these Terms.
Pali is provided to you as pre-release software for testing and evaluation. It is distributed through Apple's TestFlight service, and your use is also subject to Apple's TestFlight terms. Beta software is a work in progress: features may be incomplete, may change or be removed without notice, and may contain errors. We may update, suspend, or end the Program, or your participation in it, at any time.
Pali is a general wellness product. The beta version is not a medical device, does not provide medical advice, diagnosis, or treatment, and must not be used to make treatment decisions. Do not rely on Pali for glucose alerts or safety notifications — continue to use your CGM system's own alerts and follow the guidance of your healthcare providers. Beta software may display data that is delayed, incomplete, or incorrect.
If you think you may be having a medical emergency, call your local emergency number (such as 911) or seek immediate medical attention. Pali does not detect, monitor, or respond to medical emergencies.
The Program gives you access to non-public information, including the app itself, its features and designs, screenshots and recordings of it, documentation, roadmaps, performance characteristics, and our communications with you about it (collectively, "Confidential Information"). You agree to:
Confidential Information does not include information that becomes public through no fault of yours, that you already lawfully knew, or that we publicly release. Your confidentiality obligations for any given feature end when we make that feature publicly available, and otherwise survive for three (3) years after your participation ends.
We ask for your feedback — bug reports, suggestions, ideas, survey responses. You grant Total Life Dynamics a perpetual, irrevocable, worldwide, royalty-free license to use feedback you provide for any purpose, without obligation or compensation to you. Feedback does not include your personal data, which is handled per our Privacy Policy.
Our Privacy Policy applies to your use of the beta, including how Pali connects to your Nightscout site and Apple Health data. Beta builds may collect additional diagnostic information (such as crash reports and performance data) to support testing.
You must be at least 18 years old and reside in the United States to participate.
The beta software is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Total Life Dynamics will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from the Program or the beta software, and our total liability will not exceed one hundred U.S. dollars (US$100).
These Terms apply from your acceptance until the Program ends or your participation is terminated by you or by us. Sections 3, 4, 7, and 9 survive termination. You may leave the Program at any time by deleting the app and notifying us at andy@totallifedynamics.com.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. They are the entire agreement between you and Total Life Dynamics regarding the Program, except where a separate written agreement (see preamble) governs. If any provision is unenforceable, the rest remain in effect. We may update these Terms; continued participation after notice of changes constitutes acceptance.
